The report is based on new technololgy, in this case the the brain scanner. Qualitative analysis proves psychopaths to be dangerous. Consequently, it will be possible to prevent crime by treating innocent psychopaths before they commit a crime. In order to estimate the ethical correctness of using this method as a means to prevent crime among guiltless psychopaths, I have performed a critical discussion. During my ethical evaluation, I have included Bentham as an advocate of utilitarism, as well as Kant representing retributivism. As a means of punishing ethics, utilitarism argues that we should act according to maximizing general interests, which might lead to punishing an innocent person to preserve the welfare of society. Retributivism contrasts this idea, arguing that the legal system should leave alone persons who have not yet undertaken criminal activities. Today, our legal system is based on the Kantian theory. In case the possibility of punishing an innocent individual as a precaution to prevent crime should ever be introduced in our legal system, it requires a main change of the very basic principle of never punishing someone yet innocent.
