Europæisering af den danske forvaltning og lovgivning - et komparativ casestudie af implementering af EU-direktiver i dansk kontekst: Europeanization of the Danish administration and legislation

Abstrakt

Resumé Projektet tager udgangspunkt i antagelsen om, at Danmark anses som klassens duks i EU, når det kommer til implementeringen af direktiver fra EU. Der ses dog eksempler på, at dette ikke altid gør sig gældende, og den danske implementering af EU-lovgivning er mangelfuld. For at belyse denne mangelfulde implementering samt centraladministrationens og forvaltningens rolle heri, tager projektet udgangspunkt i to cases af hhv. habitatdirektivet fra 1992 og patientmobilitetsdirektivet fra 2011. Som en del af metoden har projektet valg at gøre brug af ekspertinterview af hhv. fuldmægtig Anna Skat Nielsen fra Ministeriet for Sundhed og Forebyggelse samt fuldmægtig Lars Rudfeld fra Naturstyrelsen. Dette valg er foretaget for at få et større indblik i centraladministrationens rolle i implementeringen af disse direktiver. Ydermere er der valgt at lave dokumentanalyser af relevante direktiver og bekendtgørelser. Ud over dette er projektets metodevalg præget af den videnskabsteoretiske tilgang, kritisk realisme, hvor der arbejdes retroduktivt, og der bliver ligeledes gjort brug af det intensive projektdesign. Projektet gør brug af en pluralistisk teoriramme for at skabe et større helhedsbillede af nationalstatens ageren, samt en forståelse af hvilke aktører, der spiller ind i implementeringen af EU-lovgivning. Der bliver gjort brug af teori fra Falkner, Versluis, Winter og Nielsen samt europæiseringsteori. Dette har ført til en analyse af, hvordan EU-lovgivning er blevet til dansk lov, samt hvilken rolle centraladministrationen og forvaltningen har haft i implementeringen af direktiverne. Projektet konkluderer, at der for det første er sket en mangelfuld implementering af de to direktiver, hvilket skyldes, at policy-designet i direktiverne ikke var klart og tydeligt i formuleringen. Udover dette gør det sig gældende, at nationale interesser har været styrende i implementeringen. Abstract This paper is based on an assumption that Denmark is considered top of the class in the European Union when it comes to the implementation of directives from the European Union. Still there are examples of this is not always the case and the Danish implementation of EU legislation is insufficient. To elucidate this insufficient implementation together with the part of the central administration and the administration this paper is using two cases of respectively the Habitats Directive from 1992 and the Patient Mobility Directive from 2011. As a part of the method this paper has chosen to expert interviews with respectively principal Anna Skat Nielsen from the Ministry of Health and Prevention and principal Lars Rudfeld from The Danish Nature Agency. This choice has been made to gain a greater insight into the part of the central administration in the implementation of these directives. Furthermore this paper has chosen to make document analyses of relevant directives and statutory instruments. In addition to this the choice of method is characterized by the scientific theoretical approach, critical realism, which operates retroductive and which uses the intensive project design. The project makes use of a pluralistic frame work of theory to create a greater overall picture of the act of the nation state together with an understanding of which participants that come into play in the implementation of EU legislation. Theories by Falker, Versluis, Wither and Nielsen and also Europeanization theory are put to use in this paper. This has lead to an analysis of how EU legislation has become Danish law and which part the central administration and administration have had in the implementation of the directives. This paper concludes that first of all an insufficient implementation of the two directives had occurred which is caused by the policy design in the directives was not clear and distinct in the formulation. Furthermore it is in evidence that the national interests have been controlling in the implementation.
