The purpose of this project is to answer the question of whether the Danish government ought to continue to criminalize the recreational use of heroin. The underlying assumptions are that since punishment is one of the worst things the state can do to its citizens, it ought to have good arguments in favor of criminalization and that criminalization should be the best way of protecting against a given harm. Since the law only states that the reason for the criminalization is that heroin (and other illicit drugs) poses a threat of harm, three plausible arguments in support of the legal prohibition of recreational use of heroin motivated by protection against harm are analyzed and discussed. The arguments are The Argument From Health, The Argument From Autonomy and The Argument From Harm To Others. The project concludes that only one of these argument (The Argument From Harm To Others) provides a good reason to justify criminalization but also concludes that none of the arguments are successful in showing that a criminalization is in fact the best way to reduce the threat of harm produced by recreational heroin use.
