Abstract
In the course of the 1980's and 1990's, children's right to be heard in legal matters has become a key issue on the family law agenda and in society at large. This is the result, in our view, of fundamental changes to the legal image of the family as it appears in national family law of modern welfare states, and is born out of the process of individualization witnessed in the last century. During the same period, the discourse of human rights has evolved into a powerful legal agenda, which we seee as closely connected to the changes to the national law of modern welfare states. In this paper we shall explore these changes to the configuration of national family law and of human rights, and reflect critically as to their interplay.
